These User Terms of Service (the "User Terms") govern your access and use of our WiFi Hotspot Services. Please read them carefully. We hope your Internet experience is excellent.
What's a User?
You are an Authorized User of a WiFi Hotspot Controlled by a "Customer"
An organization or other third party that we refer to in these User Terms as "Customer" is letting you access the Internet by way of a splash page provided by MIMO.
What This Means for You (and for Us)
Customer has separately agreed to our Customer Terms of Service or entered into a written agreement with us (in either case, the "Contract") that permitted Customer to create and configure a splash so that you and others can get online when you're visiting their business.
You must be over 16 to use the Services.
To the extent prohibited by applicable law, the Services are not intended for and should not be used by anyone under the age of sixteen. You represent that you are over the legal age and are a legitimate customer of the Customer to the Services. I.e. You're not sitting outside in a car doing naughty things.
Don't Use The Services for Illegal Purposes
Please don't use the service for anything illegal, abusive, annoying or offensive, including posting offensive content. Don't stalk, bully, harass anyone. Don't use it to spam, disrupt or interfere with the Internet, any network, computers, or other devices. Don't use it to send a virus. Be nice, the Internet is our friend. If we've missed something bad, don't do that either!
Please don't use the services to download illegal content, using P2P or any other file sharing mechanism. And while we're at it, please don't use the services to run any commercial services like servers etc. Why you would do this, we don't know.
This WiFi Service is an Internet access service provided by Cucumber Tony trading as MIMO. It provides you with access to the Internet via a wireless access point (or points). These access points utilise one or more of the 802.11a/b/g/n protocols commonly referred to as "WiFi" (the "Service"). These "Terms and Conditions" between you and MIMO set out duties and responsibilities associated with use of the Service.
When you sign-in to use the Service, you transmit personal data that may include:
- Your MAC address - the ID for your phone or computer
- IP address - the address your device has on the network
- Your email - if you chose to login with this
- Social data - Facebook, Google, Twitter details
- Your phone number - if they're using SMS logins
The Customer decides which information to ask for on the Splash Pages. This data is owned by the Customer - the Customer controls the data too. Where applicable, the Customer will include a link to their terms on the Splash Pages - particularly if they're transmitting your data to a third party. We've put this in the Customer Terms too.
Processing Your Data
We use your MAC address and other data to build a 'profile' so the Customer can understand how their businesses are being used. This includes things like:
- Number of visits including the number of times a user comes in
- Average time of visit - so they can see how long people are staying
- Demographics - where their customers are from based on the social information
- Counts of unique users
Where social logins are deployed, you can decide which personal information is shared with the Customer. You can opt-out from any email, SMS or Twitter campaigns at any point.
We're committed to your privacy and do not use any enrichment services. Nor do we sell your data to third parties.
MIMO also provides 'Automated Campaign Services' to the Customers. This means they can set-up automated messages that get sent when certain events occur. For example, when you first sign-up for the Service or when you've been back 10 times.
If you've agreed for the Customer to use your details when you signed-in for the Service, the customer may contact you from time to time. We've done our best to ensure they don't send you spam. We validate their email addresses and we require the Customer's emails comply with the US CAN-SPAM Act. Every email sent will contain an unsubscribe link. You can also update your communication preferences in your portal (see below).
If you think anyone is violating any of these Terms, please notify us immediately. If you received spam you think came from a MIMO user, please report it to our abuse team - [email protected]
Where is the data stored?

As part of the service, we allow data to be synced automatically with third party tools including:
We've gone to great lengths to ensure we only use legitimate providers who will also protect your data. The Customer has agreed to include which ones they're sharing your data with in their own terms which will appear on the splash pages.
Requesting Your Data and Updating Your Profile
We've built you a self-service portal from which you can view your usage, download and delete all your data. You can also update your communication preferences. In the event you delete your data, the Customer who operates the Service will be sent an email with the deletion details.

You agree to indemnify and hold MIMO, its directors, officers, shareholders, affiliates, agents and suppliers harmless from all liabilities and expenses related to any violation of these Terms and Conditions by you or any user of your device, or in connection with your or their use of the Service. While using the Service, you may not post, transmit or otherwise distribute information constituting or encouraging conduct that would constitute a criminal offence or give rise to civil liability, or otherwise use the Service in a manner which is contrary to law or to our policies or would serve to restrict or inhibit any other user from using or enjoying the Service or the Internet. Without limiting the foregoing, you agree not to use the Service for any commercial purpose not otherwise permitted by these Terms and Conditions.
The Service is only available where the Customer has installed an Internet service. MIMO assumes no liability whatsoever for any claims, damages, losses or expenses arising out of or otherwise relating to the unavailability of the Service in your geographical area, in particular, due to changes in the location and configuration of Hotspots.
We do not operate any Internet connections for the users - MIMO is a splash service.
MIMO does not guarantee the speed and or performance of the Services.
No failure or delay by either party in exercising any right under the User Terms, including the Acceptable Use Policy, will constitute a waiver of that right. No waiver under the User Terms will be effective unless made in writing and signed by an authorized representative of the party being deemed to have granted the waiver.
The User Terms will be enforced to the fullest extent permitted under applicable law. If any provision of the User Terms is held by a court of competent jurisdiction to be contrary to law, the provision will be modified by the court and interpreted so as best to accomplish the objectives of the original provision to the fullest extent permitted by law, and the remaining provisions of the User Terms will remain in effect.
You may not assign any of your rights or delegate your obligations under these User Terms, whether by operation of law or otherwise, without the prior written consent of us (not to be unreasonably withheld). We may assign these User Terms in their entirety (including all terms and conditions incorporated herein by reference), without your consent, to a corporate affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.
